A top aide of New York Governor Andrew Cuomo is fighting for his life after being shot in the head.
He was shot during the pre-dawn festivities for the annual West Indian Day Parade in Brooklyn, near Bedford Avenue and Sullivan Place.
The brothers were caught in violence between gangs at 3.40am, police said.
Mr Gabay was one of four men shot overnight along the parade route.
The West Indian Day Parade - also known as the J'Ouvert Festival - takes place every Labor Day in the Crown Heights neighbourhood.
It has a reputation for violence during the parties that are held overnight ahead of the parade.
Last year, three people were shot - one fatally - near the parade route.
A police spokeswoman said no arrests had been made.
In a statement, Mr Cuomo suggested that Mr Gabay was a bystander and not the intended target.
"This tragic shooting - this one by another seemingly random bullet - is the latest heartbreaking reminder that the crime of gun violence must stop," his statement said.
"Enough young, innocent people have died, and it must stop now."
In January, Mr Gabay, a Harvard-educated lawyer, was appointed first deputy counsel for the Empire State Development Corporation.
The corporation is the state's main economic development agency. Previously, he had been an assistant counsel to Mr Cuomo.
"He is just 43-years-old and is a kindhearted man," Mr Cuomo said in the statement.
About an hour and a half before Mr Gabay was shot, at a different corner of Prospect Park, a 24-year-old man was stabbed to death.
Another man, aged 21, was shot in the buttocks and taken to hospital.
